Ruth Corbin article published in Fall 2017 issue of The Trademark Reporter

The September-October, 2017 issue of The Trademark Reporter (TMR) includes an article co-authored by CorbinPartners’ chair Ruth Corbin, entitled “Internet Surveys in Intellectual Property Litigation: Doveryai, No Proveryai”. This article presents guidelines for responding to the criticism of using an Internet survey methodology and proposes standards for use by the courts as expert evidence.

 Ruth Corbin article published in 2017 Annual Review of Civil Litigation
The 2017 Annual Review of Civil Litigation, edited by Justice Todd Archibald, includes an article co-authored by Dr. Ruth Corbin, Chair of CorbinPartners Inc, entitled “Disputes over Parental Care when the Dutiful Child Wants to Be Paid”. The innovative article focuses on compensation issues related to caregivers of the elderly or infirm, and how fair reimbursement has been determined in courts across Canada.  The article expands the application of valuation principles historically used for resolving intellectual property disputes.

CorbinPartners’ survey evidence assists Federal Court with Captain Morgan matter
Consumer survey evidence from CorbinPartners assisted the Federal Court in a decision related to trademark infringement of the trade dress of Captain Morgan rum (Diageo Canada Inc v Heaven Hill Distilleries Inc). In the decision, Justice Boswell accepted the survey into evidence, and cited it as being “relevant to the issues which would be raised at trial” and “necessary to assist the trier of fact at trial”. MRIA adds Expert Evidence Chapter to Code of Conduct
The Marketing Research and Intelligence Association has added a new appendix on “Social Science as Expert Evidence” to the members’ Code of Conduct. The addition is based on Ruth Corbin’s adaptations of chapters she wrote for the Benchbook of the Federal Court of Canada and the Canadian Trademark Law Benchbook. The Appendix conveys the understanding and expectations held by legal professionals in Canada regarding the value that market research services can provide towards the administration of justice.  Read the Appendix here.

Dr. Corbin published in Annual Review of Civil Litigation
Dr. Ruth Corbin’s article “Breaking the Expert Evidence Logjam: Experts Weigh In” was recently published in the authoritative Annual Review of Civil Litigation 2016. CorbinPartners survey evidence assists Federal Court on TMOB appeal
Consumer survey evidence from CorbinPartners assisted the Federal Court in a judicial review for Bauer Hockey Corp. v. Easton Hockey Canada, Inc. In the decision, Justice Richard Bell determined that affidavit evidence, including an expert report from Dr. Ruth Corbin, “would have materially changed the outcome of the [Trademarks Opposition] Board’s decision, and in light of this evidence, the decision does not meet the standard of correctness.” In turn, Justice Bell reversed the Board’s decision to expunge the Applicant’s trademark from the Trademark Register. Ruth Corbin speaks at TLA Ethics and Professionalism session 
CorbinPartners Chair Ruth Corbin will be speaking on cognitive bias in the courtroom on Wednesday, October 19, in Toronto. Corbin will be presenting her own research on the topic, as well as moderating a judge’s discussion on the ethics of using cognitive techniques. The program also includes experienced lawyers and judges speaking on how they persuade, negotiate and decide matters in consideration of their own cognitive bias. Ruth Corbin named MRIA Fellow for distinguished career contributions
We are proud to announce that CorbinPartners Chair, Dr. Ruth Corbin, was named a Fellow of the Marketing Research and Intelligence Association (MRIA) at its annual national conference in Montreal. Among the significant citations in the nomination was Ruth’s contribution to the development of forensic market research in Canada. Canadian merchants champing at the Bitcoin for greater consumer acceptance
CorbinPartners interviewed merchants across Canada about their experience with and opinions on Bitcoin. Giles School Honours Dr. Corbin
Dr. Ruth Corbin was honoured at a gala event of the French language Giles School, for her distinguished contributions as Chair of its Board. Ruth was the first outside director appointed to the position of Chair, and led the school’s efforts to revamp its processes of governance and intellectual property protection.

The Marketing Research and Intelligence Association (MRIA) has awarded CorbinPartners the Public Policy Impact Award. CorbinPartners received this award in recognition of its market reconnaissance study pertaining to online wealth management, on behalf of Questrade Wealth Management. The study was a key factor in a game-changing decision related to investment advice and professionally managed portfolios. This was CorbinPartners’ 4th Public Policy Impact Award in five years, and its 11th research excellence award from the MRIA in the past 10 years.

Ruth Corbin speaks at Canadian Institute’s Advertising and Marketing Law Event  
Dr. Ruth Corbin was a featured speaker at the Canadian Institute’s 21st Annual Advertising and Marketing Law program in Toronto. Dr. Corbin’s session titled “Evidence and Comparative Testing” included McMillan LLP’s James Musgrove. The session dealt with adequate and proper testing, as well as what might hold up in court.

The second edition of the Canadian Trade-Mark Law Benchbook is now available through Carswell publishers. Edited by Donald M. Cameron of Bereskin & Parr, the book contains chapters by several senior and well-regarded Intellectual Property lawyers. The chapter on Surveys and Other Marketplace Evidence is authored by Dr. Ruth M. Corbin, with editorial review by members of the Litigation Resource Committee of the MRIA.

The MRIA awarded CorbinPartners (in partnership with Ipsos Canada) both the Public Policy Impact Award and the Murray Philp Altruistic Award for its ‘Client of Modest Means’ Study for Legal Aid Ontario. The Public Policy Impact Award recognizes a project that has had a demonstrable public policy impact, and the Murray Philp Altruistic Award recognizes a project completed on a pro-bono or reduced profit basis.

The Spring 2014 issue of The Advocates’ Journal features Dr. Ruth Corbin’s “The hot-tub alternative to adversarial expert evidence”, which details the evolution of the use of concurrent expert evidence. Dr. Corbin Receives Honorary Degree from Carleton University
Carleton University conferred a Doctor of Laws, honoris causa, on Ruth Corbin last week in recognition of her outstanding contributions to the law, especially in the area of intellectual property rights. Dr. Corbin was honored during the convocation for students in the Faculty of Public Affairs on June 11. She delivered the ceremony’s commencement speech which can be viewed here.

The MRIA awarded CorbinPartners the Excellence in Research Award for its National Client Needs Study for the Canadian Legal Information Institute (CanLII). CanLII’s goal is to make Canadian law accessible at no cost on the Internet. The national study surveyed more than 4,000 members of the legal community. Dr. Ruth Corbin was honoured individually with MRIA’s Award of Outstanding Merit. The award is given out only in years where MRIA decides there is a deserving recipient, and recognizes the recipient’s conspicuous and sustained service to the profession. The awards were announced on June 4 at a gala ceremony in Niagara Falls, Ont.
